Terms & Addendum

Driver Certification

I certify that:

• I am at least 21 years old and hold a valid U.S. driver's license in good standing.
• I am lawfully authorized to live, work, and operate a motor vehicle in the United States.
• I have a clean driving record (no DUI, reckless driving, or license suspension within the past five years).
• I have no criminal convictions or pending criminal charges.
• All personal and driver information I have provided to Electric Love is true, accurate, and complete.

I authorize Electric Love to verify my driving record, criminal background, and work authorization at any time.

Vehicle Use and Condition

• I will inspect the vehicle and upload required pre-trip photos before departure.
• I will upload post-trip photos immediately upon return.
• I am responsible for any unreported damage, missing accessories, or excessive wear.
• I will not smoke, vape, or transport pets in the vehicle. A cleaning fee of up to $500 may apply for violations.
• I will not use the vehicle for racing, towing, off-road driving, or illegal purposes.

Financial Responsibility

I agree that I am responsible for:

• All rental fees, tolls, charging costs, fines, and penalties;
• Vehicle damage up to the deductible ($2,500 per incident);
• Administrative and loss-of-use fees during repair downtime;
• Replacement costs for lost or damaged charging cables, keys, or accessories; and
• A Repossession Fee of $500 plus related costs if Electric Love must recover the vehicle due to nonpayment, breach, or abandonment.

Insurance and Deductible

Electric Love maintains fleet insurance meeting or exceeding state minimums. I am responsible for the deductible and any uninsured losses resulting from my negligence, policy exclusions, or violations of this Agreement.

Limited Power of Attorney

I hereby grant Electric Love LLC a Limited Power of Attorney ("LPOA") for the duration of any active rental or reservation period.

This authorization permits Electric Love to:

• Acquire, modify, extend, or terminate insurance policies or coverage on my behalf for any vehicle assigned to me under this Agreement;
• File, process, and settle insurance claims, including executing related documents or endorsements;
• Communicate directly with insurance carriers, adjusters, or agents regarding any loss, accident, or coverage issue involving the rented vehicle; and
• Endorse or negotiate insurance payments or refunds related to the vehicle's use, repair, or total loss.

This LPOA is limited solely to insurance and risk-management purposes associated with the vehicle during my rental period. It terminates automatically when the vehicle is returned, all charges are settled, and the rental is formally closed.

Telematics and GPS Consent

I understand that Electric Love vehicles include GPS and telematics systems that record vehicle location, speed, charging, and diagnostic data. I consent to the collection and use of this data for fleet management, safety, insurance, and loss prevention.

Indemnification

I agree to indemnify, defend, and hold harmless Electric Love LLC, its officers, employees, and affiliates from all claims, damages, losses, and expenses (including attorneys' fees) arising from my use or possession of a vehicle, my violation of law, or any misrepresentation I have made.

Arbitration Agreement & Class Action Waiver

I agree that any dispute, claim, or controversy arising out of or related to this Agreement or my use of Electric Love vehicles will be resolved by binding arbitration before a single neutral arbitrator under the American Arbitration Association (AAA) Commercial Rules, applying Texas law in Travis County, Texas.

I waive my right to a jury trial and agree that any claims must be brought individually, not as part of a class or collective action. The arbitrator's award will be final and enforceable in any court of competent jurisdiction.

Graves Amendment Compliance

I understand that Electric Love LLC operates solely as a vehicle lessor and is not vicariously liable for any harm arising out of the operation of a rented or leased vehicle, except in cases of direct negligence or criminal wrongdoing by Electric Love.

Termination and Repossession

Electric Love may disable or repossess the vehicle immediately if I breach these terms, fail to make payment, or misuse the vehicle. Repossession does not waive Electric Love's right to recover additional damages or fees owed.

Acknowledgment and Signature

I have read, understand, and agree to the Electric Love LLC Terms of Use and this Rental Agreement Addendum, including the Limited Power of Attorney authorizing Electric Love to manage insurance coverage related to the vehicle during my rental.

I understand this document is a legally binding contract between myself and Electric Love LLC.
